1. Acceptance of Terms

By creating an account or using FlakyWatch, you confirm that you:

• Are at least 16 years old
• Have the authority to accept these Terms on behalf of yourself or your organization
• Will comply with all applicable laws and regulations

2. Description of Service

FlakyWatch is a software-as-a-service (SaaS) platform that:

• Monitors GitHub Actions test results
• Detects, classifies, and tracks flaky tests
• Calculates estimated CI and developer time costs
• Creates and manages GitHub issues for flaky tests
• Sends weekly digest emails to opted-in users

3. Account Registration

You register through GitHub OAuth. You are responsible for:

• Maintaining the security of your GitHub account
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access

You may not share your account or use someone else's account without permission.

4. Plans and Payment

4.1 Free Plan

The Free plan is offered at no cost with the following limits: 1 repository and 14-day data history.

4.2 Paid Plans

Paid plans (Starter, Team) are billed monthly. By subscribing, you agree to:

• Pay all fees as they become due
• Provide accurate billing information
• Authorize recurring charges to your payment method

4.3 Changes to Pricing

We reserve the right to modify pricing. Existing subscribers will receive at least 30 days' notice before price changes take effect.

4.4 Refunds

Monthly subscriptions are non-refundable. You may cancel at any time and will retain access until the end of your billing period.

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to reverse engineer, decompile, or disassemble the Service
• Circumvent any technical limitations or security measures
• Use the Service to send spam or unsolicited communications
• Impersonate another person or entity
• Resell or redistribute the Service without written permission
• Submit malicious data, viruses, or harmful code
• Exceed reasonable usage limits (excessive API calls, abuse of free tier)

Violation of these rules may result in account suspension or termination without refund.

6. Intellectual Property

6.1 Our Property

The Service, including all software, designs, logos, and content, is owned by FlakyWatch. You may not copy, modify, or distribute any part of the Service without written permission.

6.2 Your Data

You retain ownership of all data you submit to the Service. By using FlakyWatch, you grant us a limited license to process your data solely for the purpose of providing the Service.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not warrant that:

• The Service will be uninterrupted or error-free
• Flaky test classifications are 100% accurate
• Cost estimates reflect actual expenses precisely
• The Service will meet your specific requirements

FlakyWatch is a tool to help you make decisions; it is not a replacement for engineering judgment.

9. Limitation of Liability

To the fullest extent permitted by law, FlakyWatch shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding the amount you paid us in the preceding 12 months

10. Indemnification

You agree to indemnify and hold harmless FlakyWatch from any claims arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights

11. Termination

11.1 By You

You may stop using the Service at any time by uninstalling the GitHub App and deleting your account.

11.2 By Us

We may suspend or terminate your account for:

• Violation of these Terms
• Extended period of inactivity
• Non-payment of fees
• Legal or regulatory requirements

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notice at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict of law principles.
